Arbitration and mediation are both forms of alternate dispute resolution.

ARBITRATION

Arbitration is based on the intervention by a third party in an attempt to reach an agreement, but the final decision lies with the arbitrator. Arbitration is a private judicial hearing with an outcome that binds the parties and puts an end to the dispute between them. The parties choose their arbitrator. The matter is heard privately at a time and place that is agreed upon by all parties.

MediateSA can only arbitrate matters when the parties agree to arbitration or when an arbitration clause is applicable.

The following matters can not be arbitrated:

  1. Divorce
  2. Criminal matters
  3. Issues of status
  4. The liquidation of a company.

MEDIATION

Mediation is widely used in all sorts of disputes: commercial, family (divorce), labor, and civil
